MAJESTA “Trees of Knowledge” Competition (the “Competition”)

NO PURCHASE NECESSARY:

MAJESTA “Trees of Knowledge” Competition is made up of three (3) elements with the goal of the Competition is to generate inspiring, creative ideas where students can learn “outside the traditional classroom”. 

The first element is for Canadian schools (from Canadian Primary schools to Canadian High schools) to submit an application (see Rule 3 for submission requirements) for a chance to win a $20,000* Outdoor Classroom.

Plus Canadians can show support in the MAJESTA “Tree of Knowledge” Competition by placing a vote for one of the ten (10) finalists once a day during the voting period.

Play the Tree-Twist game in the MAJESTA “Trees of Knowledge” Competition for a chance to win $10,000† CDN (see Rule 8 for more details).

  1. ELIGIBILITY:

    SCHOOL ELIGIBILITY: For the MAJESTA “Trees of Knowledge” school competition (the “Competition”), submissions must be submitted by an individual who will act as the “School representative” for the Competition. The School representative must: (a) be a legal resident of Canada; (b) be located in Canada at the time of entry; (c) have reached the age of majority in his/her province or territory of residence at the time of entry; (d) have consent and permission from the Canadian Primary school or Canadian Middle school or Canadian High school referred in the submission and the associated school board to participate and submit a submission form for the school in the Competition and (e) have and use only one (1) valid e-mail address to participate in the Competition.

    VOTING ELIGIBILITY: To place a vote in the Competition, individuals must: (a) be a legal resident of Canada; (b) be located in Canada at the time of entry; (c) have reached the age of majority in your province or territory of residence at the time of entry; and (d) have used only one (1) valid e-mail address to participate in the Competition.

    CONTEST ELIGIBILITY: To enter the Contest phase of the Competition (describe below), an individual must: (a) be a legal resident of Canada; (b) be located in Canada at the time of entry; (c) have reached the age of majority in his/her province or territory of residence at the time of entry; and (d) have used only one (1) valid e-mail address to participate in the Competition.

    The following sections apply to all of School eligibility, Voting eligibility and Contest eligibility:

    Employees, officers, and directors (and those with whom such persons are domiciled, whether related or not and members of their immediate families and of the same household) of Irving Tissue Corporation (the "Sponsor"), Tree Canada, Forests Ontario, Focus on Forests, their affiliates (including, without limitation, their parent, sister and subsidiary companies), the Judges (see Rule 4 below), advertising or promotional agencies, independent contest organization, suppliers of materials or services related to the Competition are not eligible to participate in any of the below sections of the Competition.  For these Official Rules, "related" means mother, father, sister, brother, son, daughter and spouse, including common law spouse, regardless of where they reside.

    The Sponsor shall have the right at any time to require proof of identity and/or eligibility to participate in the Competition. Failure to provide such proof may result in disqualification. All personal and other information requested by and supplied to the Sponsor for the purpose of the Competition must be truthful, complete, accurate and in no way misleading. The Sponsor reserves the right, in its sole discretion, to disqualify any individual or school, should such individual or school at any stage supply untruthful, incomplete, inaccurate or misleading details (including personal details) and/or information or if an individual has not personally submitted his/her personal information or has otherwise not complied with these Official Rules. Decisions of the Sponsor are final and binding in all matters related to this Competition and the awarding of any prize. Groups, clubs, organizations, business and commercial and non-commercial entities cannot enter the Competition.

  2. COMPETITION PERIODS: The Competition starts at 12:00:00 PM (ET) on September 3, 2014 and closes at 11:59:59 AM (ET) on May 4, 2015 (the "Competition Period"). There are seven (7) Phases to the Competition including a Submission Period, a Voting Period and a Contest Period. The Competition computer system (the “Competition computer”) is used to govern all computer and time-related aspects of the Competition and, among other things, is the official time-keeping device for the Competition.

    1. Phase 1 – School Submissions: Submissions (“Submissions”) will be accepted between 12:00:00 PM (ET) on September 3, 2014 and 11:59:59 PM (ET) on January 19, 2015 (the “Submission Period”). All Submissions must be received on or before 11:59:59 PM (ET) on January 19, 2015 (the “Submission Closing Date”).

    2. Phase 2 – Selection of Submissions as Finalists: All Submissions received during the Submission Period will be reviewed by a panel of Judges commencing on or about January 21, 2015 and concluding on or before February 4, 2015. The ten (10) Submissions who receive the highest cumulative score as determined by the Judges will be selected as Finalists (see Rule 4). Each School representative from the ten (10) Submissions selected will be contacted within five (5) business days of February 5, 2015.

    3. Phase 3 – Voting Period: Individuals can place a vote once per Day for any of the ten (10) Finalists between 12:00:00 PM (ET) on April 7, 2015 and 11:59:59 AM (ET) on May 4, 2015 (the "Voting Period"). All votes must be received on or before 11:59:59 AM (ET) on May 4, 2015 (the "Voting Closing Date").

    4. Phase 4 – Determination of Finalists prizes: After the Voting Closing Date, all votes will be reviewed and tabulated. Each School representative of the ten (10) Finalists will be contacted on or about May 19, 2015 to award each Finalist with his/her eligible prize. Announcement of the winners will be available on the Competition website at www.majesta.com on or about June 1, 2015.

    5. Phase 5 – Most Creative Prize for Finalists: After the Voting Closing Date, each School representative of the ten (10) Finalists will have five (5) business days to submit up to ten (10) written summaries of their most unique idea(s) to promote their school within this Competition including submitting pictures and/or videos. See Rule 7 below for further details. Each School representative on behalf of each Finalist has until 11:59:59 PM (ET) on May 8, 2015 (the “Most Creative Prize Closing Date”) to submit the school information for a chance to win the Most Creative Prize. Should any Finalist not submit the requirements as defined in Rule 7 below, the Finalist will not be eligible for the Most Creative Prize.

    6. Phase 6 – Contest Period: Individuals can enter the Contest phase of the Competition between at 12:00:00 PM (ET) on April 7, 2015 and 11:59:59 AM (ET) on May 4, 2015 (the “Contest Period”). All entries must be received on or before 11:59:59 AM (ET) on May 4, 2015 (the “Contest Closing Date”). Note individuals wishing to participate in the Contest phase will be required to place a vote for a Finalist prior to entering the Contest phase.

    7. Phase 7 – Contest Draw: A random draw will be held on May 19, 2015 to award the Contest Prize consisting of $10,000 CDN.

  3. PHASE 1 – SCHOOL SUBMISSION REQUIREMENTS: Canadian schools (from Canadian Primary schools to Canadian High schools) wishing to participate in the Competition must select a School representative to complete the on-line submission form which can be found at www.majesta.com.  Submissions must include the following mandatory components:

    1. School representative contact information including the principal name; a staff project representative and a parent project representative;

    2. A 400 word essay in English or French on why you believe that your school should be chosen to receive an Outdoor Classroom;

    3. A description of the conditions of the existing school grounds complete with dimensions, up to six (6) photographs of the grounds and an optional video. Photographs are to be provided as attachments and should be no larger than 2MB and in either jpg; jpeg; gif; png; or bmp format. The video must be no longer than two (2) minutes in length and must be in one (1) of the following formats (wmv, 3gp, avi, mov, mp4, mpeg /mpegps, flv, swf, mkv or webm). The file size should not exceed 80 MB. NOTE: Any school selected as a Finalist and if they did not submit a video at the time of Submission will require to submit a two minute video on or before the designated date;

    4. A description of your Outdoor Classroom project including (a) a list of three (3) to five (5) objectives for your school’s Outdoor Classroom (100 word maximum in English or French); (b) a landscape plan of your proposed project; (c) a description of how you plan to maintain the Outdoor Classroom if your school should be chosen as the winner of the Outdoor Classroom (100 word maximum in English or French); (d) your project timelines showing an Outdoor Classroom completion date of October – November 2015; (e) an overview of the role students, parents, staff and the surrounding community will have in the planning, site preparation, planting and celebratory event of your Outdoor Classroom;

    5. A list of all program partners with their contributions including providing a description of fundraising efforts including estimated amounts and costs for your project including any partner’s requirements to partner with the School (such as signage, acknowledgements);

    6. A brief description (100 word maximum in English or French) of how you would promote your school’s project to gain votes in the voting segment if your school is selected as a Finalist; (the “Submission”).

    RULES REGARDING SUBMISSIONS:

    Your Submission: (1) must be your original creation. Modifying, enhancing or altering a third party's pre-existing work does not qualify as original creation; (2) must not violate the rights of any third party. For example, your Submission must not defame, infringe or violate publicity or privacy rights of any person, living or deceased, or otherwise infringe upon any person’s, entity’s or organization’s personal or proprietary rights, including but not limited to, intellectual property rights; (3) must not have been published previously, used commercially, submitted prior to this Competition or during this Competition to another competition or promotion other than the previous year’s MAJESTA Competition for which the school will be permitted to re-submit their Submission, or won any other award; (4) must be in “good taste” and must not be explicit or offensive, as determined by the Judges and/or Sponsor, in its or their sole and absolute discretion; and, (5) must not contain any commercial content that promotes any product or service other than those offered by Sponsor. Sponsor’s right to use the Submission shall not be restricted. The School representative must be able to provide legal releases for unrestricted use of any Submission that includes a third party’s name, likenesses, or work ("Third Party Elements") in a form satisfactory to Sponsor at the time of notification.

    Sponsor’s Rights to Submission: By submitting a Submission the School representative on behalf of the school: (1) agrees to irrevocably, perpetually, and without limitation, grant Sponsor the right to use, publish, adapt, sub-license, edit, display, reproduce in whole or in part, dispose of, and/or modify such Submission and the concepts and Third Party Elements embodied therein in any way, in commerce, and in any and all media worldwide, and waive all your rights, including moral rights, in the Submission, without notice or compensation, and agree that the School representative on behalf of the school may be required to sign a release to that effect. This includes Sponsor use of the school’s concept plan, and otherwise, in any marketing, advertising and promotional materials, without notice or compensation to the school, or any other third party; (2) agrees to irrevocably assign and transfer to or waive in favour Sponsor any and all rights, title, interest and claim, which the school now has or may have in the future, to the Submission, and the concepts and Third Party Elements embodied therein, including without limitation, the copyright and/or moral rights therein, and sales, and licensing rights; (3) agrees to not upload, download, distribute, disseminate, copy, reproduce the Submission or otherwise cause the Submission to be on any public website other than www.majesta.com, and, (4) represents and warrant that the Submission does not contravene or infringe on anyone else’s copyright or other intellectual property, is not false, inaccurate or misleading and does not violate any law or regulation; is not libellous, threatening or harassing; does not instigate others to commit illegal activities; and does not contain pornography; does not contain any viruses, worms, or other computer programming intended to or that could interfere with the ability of others to enjoy the Competition website. Sponsor reserves the right to reject any Submission, which Judges or Sponsor, in its or their sole and absolute discretion, determines does not meet these Official Rules.

    PHOTOGRAPHS / VIDEO: Any photograph or video submitted must be a school’s original creation created by the school or by an individual from the school, and must be taken after September 1, 2014 or if any photograph or video has been taken by a professional for the school, the school must have the consent of, and a waiver of moral rights from, the videographer/photographer in and to the photographs and/or video and all components thereof to enter the Competition. Photographs and/or video must not contain any reference to or likeness of any identifiable third parties unless it is a property owned or operated by the school itself where it will be accepted. If any photograph and/or video contains reference to or likeness of any identifiable third party consent must be obtained from all such individuals.  

    If the video or photographs include or contain individuals and if any individual appearing in the video/photograph are minors (less than 18 years of age), the individuals face should be unrecognizable or the school should ensure that they have obtained written consent forms from all such individual(s) parents or legal guardians to post the video on a public website which could be viewed by the general public at majesta.com. Modifying, enhancing or altering a third party's pre-existing work does not qualify as an individual’s original creation.

    IMPORTANT: If your school is selected as a Finalist, you may encourage your friends and other eligible individuals to vote for your Submission; however, votes must be submitted by the individual submitting his/her personal information and not by any other person, group or organization on behalf of any individuals. Finalists are not allowed to offer any individual or group of individuals any form of incentive (example: vote exchange/will return votes), inducement, prize or chance of receiving any incentive, inducement, or prize in furtherance of receiving such individual’s vote for any Finalist. Any individual or Finalists determined by the Sponsor and/or its representatives (in their sole and absolute discretion) to be engaging in such behaviour is subject to disqualification at Sponsor’s sole discretion.

    LIMIT: A school may submit one (1) Submission Form during the Submission Period. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. Submissions that are generated by script, macro, robotic, programmed, or any other automated means are prohibited and will be disqualified. Submissions that are late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, that have been submitted through illicit means or do not conform with or satisfy any or all of the conditions the Official Rules will be judged void. All Submissions become the property of Sponsor upon receipt and none will be returned.

  4. PHASE 2 – SELECTION OF FINALISTS AND CONFIRMATION: JURY COMMITTEE: The Judges will be comprised of three (3) individuals (the “Judges”). Decisions of the Judges are final and binding on all matters relating to this Competition.

    SELECTION CRITERIA: The Judges will review all Submissions received by the Submission Closing Date and score each Submission based on the following Criteria:

    1. Is the school deserving – 25 points: Why does the school feel it needs and deserves this Outdoor Classroom? How will the school and community benefit from this?

    2. A well thought out plan – 25 points: Does the school have a solid plan which includes key objectives, landscaping plan, maintenance and a realistic timeline?

    3. Likelihood of Success – 25 points: Does the school have a strong plan for involving parents, teachers, students and the community in the project? Will the plan require additional funding? If so, is there a plan to obtain additional funding?

    4. Promotion Plan – 25 points: Does the school have a robust plan to drive support during the voting phase of the Competition? (Community support, local media, social media etc), (together, the “Criteria”).

    Each Submission may receive the maximum possible points of one hundred (100) from each Judge.

    FINALIST SELECTION: The ten (10) Submissions that receive the highest overall score among all eligible Submission received on or before the Submission Closing Date will each be selected as an eligible “Finalist”. Odds of a Submission being selected depend on the number and quality of Submissions received. The selection process will commence on January 21, 2015 and conclude on February 4, 2015. In the event of a tie, the tied Submissions will be judged according to the Criteria as set out above by an additional Judging member who will serve as the tiebreaker. If a Submission is not selected as a Finalist, there is no recourse, regardless of whether one Submission is similar in content or likeness to any Finalist.

    FINALIST CONFIRMATION: Each School representative from the ten (10) Finalists selected will be contacted by the independent contest organization by e-mail or telephone within five (5) business days of February 5, 2015 or as soon as the Judges have selected the ten (10) eligible Finalists. Each School representative acting on behalf of a selected school will be required to complete a Sponsor's Declaration of Compliance and a Release of Liability and Publicity Release form (see Section 11 below). In the event that any eligible School representative cannot be contacted within five (5) business days by e-mail or telephone, the eligible School representative and school will be disqualified, and at the sole and absolute discretion of the Judges, another Submission (the next Submission with the highest score) will be selected and the School representative from the school of the Submission will be notified. The above process will be repeated until ten (10) Submissions have been confirmed as Finalists.

  5. PHASE 3 – VOTING PERIOD: To vote for a Finalist in the Competition visit www.majesta.com, and select the “MAJESTA Trees of Knowledge Voting Competition” icon. To view the ten (10) Finalists prior to submitting a vote click on “School Finalists” tab.

    1. Enter your e-mail address; province; date of birth and select “Continue”;

    2. First time visitor: If you are not recognized as having already completed a Registration Form, you will be required to complete the Registration Form with your full name, complete mailing address, and daytime telephone number (collectively, "Registrant's Information"); check the box to confirm that you have read, accepted and agree to be bound by the Official Rules and Privacy Policy; check the box if you wish to receive future communications from the Sponsor and select “Submit”;

    3. Upon receipt of the Registration Information an individual can begin to vote for a Finalist;

    4. Review the ten (10) Finalists and click on the Finalist that you wish to vote for and select “Submit”;

    5. Upon receipt of a successful vote an individual will receive a “Thank you for voting” message.

    IMPORTANT: Individuals and/or Finalists, you may encourage your friends and other eligible individuals to vote for your Submission; however, votes must be submitted by the individual submitting his/her personal information and not by any other person, group or organization on by an individual on behalf of another individual. You are not allowed to offer any individual any form of incentive (example: will return votes), inducement, prize or chance of receiving any incentive, inducement, or prize in furtherance of receiving such individual’s vote for a Finalist. Any votes received from an individual as determined by the Sponsor and/or its representatives (in their sole and absolute discretion) to be engaging in such behaviour is subject to disqualification and/or the votes received from such individual or Finalist will be disqualified.

    VOTING LIMITS: Individuals can place one (1) vote per Day. A Day is defined as commencing at 12:00:00 am (ET) and ending at 11:59:59 PM (ET). Any individual who is found to have participated in excess of the VOTING LIMITS as defined above, or has used more than one (1) e-mail address or has not submitted their information personally, will be disqualified and all votes received by such individual during the Voting Period will be disqualified. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. Votes that are generated by script, macro, robotic, programmed, or any other automated means or deemed to be submitted by a individual on behalf of several entrants are prohibited and will be disqualified. Votes that are late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular, that have been submitted through illicit means or that do not conform with or satisfy any or all of the conditions the Official Rules will be judged void. All votes become the property of Sponsor upon receipt and none will be returned.

  6. PHASE 4 – DETERMINATION OF PRIZES FOR THE FINALISTS:

    DETERMINATION PROCESS: Commencing on or about May 5, 2015 and concluding on or about May 15, 2015 all votes received on or before the Voting Closing Date will be reviewed to ensure each vote conforms to the Official Rules. If required any ineligible votes will be disqualified and all remaining votes will be tabulated. The Finalist that received the highest overall number of eligible and valid votes will be selected as the eligible Finalist for the $20,000* Outdoor Classroom. The nine (9) remaining Finalists will be eligible for a Finalist Prize as defined in Rule 10 below. Odds of receiving the highest overall number of eligible and valid votes depends on the number of eligible and valid votes received during the Voting Period. In the event of a tie, the tied Finalists will be judged according to the Criteria as set forth in Phase 2 above by an additional Judge who will serve as a tiebreaker. Each School representative from all eligible Finalists will be contacted by the independent contest organization via telephone or e-mail within five (5) business days of May 19, 2015 to advise the Finalist of its eligible Prize. In the event that any School representative of a school cannot be contacted within five (5) business days by e-mail or telephone, the eligible School representative and school will be disqualified, and at the sole and absolute discretion of the Judges, the Submission with the next highest number of votes if applicable will be notified and the above process will be repeated until such time as there is one (1) Outdoor Classroom prize winner or no more eligible Finalists are available.

    CONFIRMATION:  To be confirmed a winner of a Prize, the School representative on behalf of the school must: (i) reply to eligible winner notification within the indicated time frame by e-mail or fax; (ii) correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question to be administered by telephone during a pre-arranged, mutually convenient time; (iii) be in full compliance with these Official Rules; and (iv) sign and return via e-mail or fax within indicated time frame of it being sent, Sponsor's Declaration of Compliance and a Release of Liability and Publicity Release form.

  7. PHASE 5 – MOST CREATIVE PRIZE FOR FINALISTS: Finalists will also be eligible for the Most Creative Prize. Each Finalists will be required to submit via e-mail (e-mail address will be provided at the time of being confirmed a Finalist) the following elements on or before 11:59:59 PM (ET) on May 8, 2015 (the “Most Creative Prize Closing Date”). Finalists can submit up to ten (10) unique ideas however each idea must be submitted separately. If any Finalist should choose not to submit the information below, the Finalist will not be eligible for the Most Creative Prize. Each submission must include:

    1. A written summary of the most unique idea that their school created and executed during the competition (maximum 100 words in English or French);

    2. Up to five (5) photographs and/or one (1) video about their school’s most unique idea throughout the Voting Period (not mandatory);

    3. Up to ten (10) copies of any promotional material the Finalist created to promote this unique idea during the Voting Period (not mandatory).

    SELECTION CRITERIA: The Judges as define in Rule 4 above will review all material submitted by each Finalist and score each Finalist based on the following Criteria:

    1. Creativity – 75 points: How unique and inventive was the Finalist’s idea

    2. Enthusiasm and community engagement – 25 points: The effort put into the idea, and how effective the idea was in creating enthusiasm and community engagement.

    Each Finalist may receive maximum possible points of one hundred (100) from each Judge.

    MOST CREATIVE SELECTION PROCESS: The selection process will commence on May 11, 2015 and conclude on May 15, 2015. The Finalist that receives the highest overall score among the Submissions received as determined by the Judges will be selected as the eligible winner for the Most Creative Prize. In the event of a tie, the tied Submissions will be judged according to the Most Creative Criteria as set out above by an additional Judging member who will serve as the tiebreaker. If a Submission is not selected as the Most Creative winner, a Finalist has no recourse, regardless of whether the Submission is similar in content or likeness to another Finalist.

    MOST CREATIVE CONFIRMATION:  To be confirmed a winner of The Most Creative Prize, the School representative must: (i) reply to eligible winner notification within the indicated time frame by e-mail or fax; (ii) correctly answer without assistance of any kind, whether mechanical or otherwise, a time-limited, mathematical skill-testing question to be administered on the Prize Form; (iii) be in full compliance with these Official Rules; and (iv) sign and return via e-mail or fax within indicated time frame of it being sent, Sponsor's Declaration of Compliance and a Release of Liability and Publicity Release form.

  8. PHASE 6 – CONTEST PERIOD: To enter the Contest phase of the Competition visit www.majesta.com, and select the “MAJESTA Trees of Knowledge” Competition icon. Prior to reaching the Contest phase individuals will be required to place a vote for a Finalist.

    1. Enter your e-mail address; province; date of birth and select “Continue”;

    2. First time visitor: If you are not recognized as having already completed an Registration Form, you will be required to complete the Registration Form with your full name, complete mailing address, and daytime telephone number (collectively, "Registrant's Information"); check the box to confirm that you have read, accepted and agree to be bound by the Official Rules and Privacy Policy; check the box if you wish to receive future communications from the Sponsor and select “Submit”;

    3. Upon receipt of the Registration Information an individual must first vote for a Finalist prior to reaching the Contest webpage; Review the ten (10) Finalists and click on the Finalist that you wish to vote for and select “Submit”;

    4. Upon receipt of a successful vote an individual will receive a “Thank you for voting” message. To enter the Contest phase, select either the “FAST” or “FUN” method of entry. Remember you receive one (1) entry by entering the “FAST” method and receive two (2) entries if you enter the “FUN” method.

    5. If you selected the “FAST” method you will receive a “Thank you for entering” message and will have received one (1) entry into the Contest.

    6. If you selected the “FUN” method you will receive a webpage with instructions on how to play the “Tree-Twist” game. To play the game individuals must un-scramble the word that appears on the webpage within one (1) minute and select “Submit”;

    7. Upon receipt of your answer you will receive one (1) of the following messages: “The answer was correct and you have received two (2) entries for the chance to win $10,000 CDN” or if your answer was incorrect you will receive the correct answer and you have received two (2) entries for the chance to win $10,000 CDN.

  9. PHASE 7 - CONTEST DRAW: A random draw will be held on May 19, 2015 at approximately 10:00 AM (ET) (the “Draw Date”) in Oakville, ON from all eligible entries received during the Contest Period. Odds of being selected for the Contest Prize will depend on the total number of eligible entries received during the Contest Period.  The selected entrant will be contacted by e-mail or telephone within five (5) business days of the Draw Date, and must be confirmed as a winner as defined in Rule 11 below. In the event that the selected entrant cannot be contacted within five (5) business days, the entrant will be disqualified, and at the sole and absolute discretion of the independent contest organization, and the above process will be repeated until a winner is confirmed.

    CONFIRMATION:  To be confirmed a Contest Prize winner, the individual must: (i) reply to the potential winner notification within the indicated time frame by e-mail or fax; (ii) correctly answer without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question posed on the Prize Form; (iii) be in full compliance with these Official Rules; and (iv) sign and return via e-mail or fax within indicated time frame of it being sent, Sponsor's Declaration of Compliance and a Release of Liability and Publicity Release form. If the selected individual cannot be contacted and confirmed a winner as above, he/she will be disqualified at the sole and absolute discretion of the Sponsor and/or Judges, his/her entitlement to receive the Contest Prize will be forfeited, and awarded to an alternate eligible individual at Sponsor’s sole discretion. No correspondence will be entered into except with the selected individual.

  10. PRIZES: A total of twelve (12) prizes are available to be won.

    1. OUTDOOR CLASSROOM PRIZE: There will be one (1) Outdoor Classroom prize available to be won among the ten (10) Finalists. The Outdoor Classroom prize consists of: Tree Canada contributing a non-cash expert consultation from Tree Canada & Forests Ontario, Focus on Forests valued at $2,500 (CDN) and $17,500 (CDN) (issued in the form of a cheque) towards the implementation of an Outdoor Classroom by the selected Finalist and school. Approximate retail value of the Outdoor Classroom Prize is $20,000 CDN. Tree Canada will provide 100% of the awarded funds to the school based on the performance of the school fulfilling its obligations to Tree Canada and its partners and providing a final report and evaluation of your project; the school must carry out and complete the project described in the Submission Form at the times and places indicated in the Submission Form within reason; allow Tree Canada and the Sponsor the right to publicity, reasonable access to the project site for observation and in order to promote and photograph the project; agree to display signs and logos to promote Sponsors MAJESTA “Tress of Knowledge” Competition; agree to dedicate at least one (1) day to promote the MAJESTA “Trees of Knowledge” Competition including but not limited to displaying signs and logos of partners, official ceremony, speaking opportunity and media coverage; agree to keep accurate records and proof of expenditures and provide Tree Canada access to this information; provide Tree Canada with a final project report complete with a photo study of the project as it was implemented (Note: A Report of Evaluation Format will be provided to the school). The school must complete their Outdoor Classroom by November 2015. The school may submit their invoices for reimbursement to Tree Canada as the school begins to incur expenses towards the implementation of the Outdoor Classroom to a maximum reimbursement amount of $17,500 CDN. If the school implementation invoices and/or expenses, totals more than $17,500 CDN the school will be responsible for all payments of their invoices/expenses over and above the $17,500 CDN. 

    2. FINALISTS PRIZES: Nine (9) Finalists Prizes are available to be won among the remaining nine (9) Finalists.

      1. The Finalist that received the second highest number of votes will receive $5,000 CDN.

      2. The Finalist that received the third highest number of votes will receive $3,000 CDN.

      3. The Finalist that received the fourth highest number of votes will receive $2,000 CDN.

      4. The remaining six (6) Finalists will each receive $1,000 CDN.

      Each Finalist Prize will be awarded in the form of a cheque made payable in the school’s name as it appears on the Submission Form. Cheques will be sent by mail/courier within thirty (30) days of receiving a signed Prize Form (see Rule 11 below).

    3. MOST CREATIVE PRIZE: One (1) Most Creative Prize will be available to be won amongst the Finalists who submitted the requirements as defined in Rule 7 above. The Most Creative Prize consists of $3,000 CDN. The prize will be awarded in the form of a cheque made payable in the school’s name as it appears on the Submission Form. The cheque will be sent by mail/courier within thirty (30) days of receiving a signed Prize Form (see Rule 11 below). Submission for the Most Creative Prize will not change the odds of winning either the Outdoor Classroom Prize or a Finalists Prize.

    4. CONTEST PRIZE: One (1) Contest Prize will be available to be won. The Contest Prize consists of $10,000.00 CDN. The Contest Prize will be awarded in the form of a cheque made payable in the individuals name as it appears on his/her Registration Form. The cheque will be sent by mail/courier within thirty (30) days of receiving a signed Prize Form (see Rule 11 below).

    Prizes must be accepted as awarded, without substitution, transfer, exchange or assignment. The Sponsor reserves the right, in its sole and absolute discretion and for any reason whatsoever, to substitute a Prize or a component of a Prize cannot be awarded as described for any reason. Prizes are awarded “as is” without any express or implied representations or warranties.

  11. RELEASE OF LIABILITY CONSENT TO PUBLICITY: By completing and returning the Sponsor's Declaration of Compliance and a Release of Liability and Publicity Release form (the “Prize Form”), and accepting either being a Finalist and/or accepting a Prize, the School representative and school or the selected individual: (i) confirms compliance with the Official Rules and / or Submission Form; (ii) acknowledges that the Prize is not transferable and must be accepted as awarded (not applicable to the Finalists process); (iii) consents to the use of his/her school name and/or individual name, address (city and province), photographs, videos, image or illustration submitted, statements regarding the Competition or a Prize and/or voice, without further remuneration, in connection with any publicity carried out by or on behalf of Sponsor with respect to the Competition in any media whatsoever including social media outlets; and (iv) releases Sponsor, Tree Canada, Forests Ontario, Focus on Forests, their affiliates (including, without limitation, its parent, sister and subsidiary companies), advertising and promotional agencies, the independent contest organization, the Judges, suppliers of materials or services related to the Competition and all of their respective shareholders, directors, officers, employees and agents (collectively, the "Releasees") from and against all liability in connection with the Competition and/or the awarding and/or use of a Prize, including, as set out below in the LIMITATION OF LIABILITY section and consent to irrevocably assign and transfer to or waive in favour the Sponsor any and all rights, title, interest and claim, which they now have or may have in the future, to the Submission including copyright and moral rights. By accepting a Prize, each School representative and school and the selected individual acknowledges that they cannot promote or advise anyone of their eligible prize or placement until such time as the Sponsor has released their press releases to the press. The Prize Form must be returned within the time period specified on the Prize Form or the Prize will be forfeited.

  12. LIMITATION OF LIABILITY: The Releasees do not assume any responsibility and individuals including entrants, School representatives and the school itself releases the Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with participation or attempted participation in the Competition, including, without limitation, the administration of the Competition, the selection and confirmation of a winner, and the arranging, awarding and use of any Prize. Without limiting the generality of the forgoing, the Releasees are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete Submissions, votes, entries, that are altered or otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Official Rules and or the Submission Form/Registration Form; (iii) any loss, damage, or claims caused by the awarded Prize or the Competition itself; (iv) any failure of the website during the Competition Period, including, without limitation, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, technical malfunctions of any computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an individual’s or any other person's computer related to or resulting from participating in or downloading any material connected to the Competition, all of which may affect a person's ability to participate in the Competition; (v) any errors, omissions, incorrect or inaccurate information in any Competition-related materials, including, without limitation, printing or advertising errors or failure of, or problems with any equipment or programming associated with or used in the Competition howsoever caused; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise or (vii) any claims regarding the accepting, arranging, awarding or use of any Prize.  Entry material/data that has been tampered with or altered is void. 

  13. CONDITIONS OF ENTRY:  By entering the Competition, individuals agree to read and abide by these Official Rules and the Submission Form/Registration Form and the decisions of the independent contest organization, Judges and Sponsor, made in their sole and absolute discretion, which shall be final and binding in all matters relating to this Competition and the awarding of a Prize. Individuals who have not complied with these Official Rules and the Submissions Form/Registration Form are subject to disqualification.

  14. UNSPORTSMANLIKE CONDUCT: The Sponsor reserves the right, in its sole and absolute discretion, to disqualify any individual, School representative or the school itself that the Sponsor or the Judges finds to be: (a) violating the Official Rules and or the Submission Form/Registration Form; (b) tampering or attempting to tamper with the entry process or the operation of the Competition or the Competition Website; (c) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person or (d) attempting to undermine the legitimate operation of the Competition by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Sponsor representatives. If Sponsor suspects that an individual has engaged in an unsportsmanlike or disruptive manner, the individual will be contacted as soon as practicable. CAUTION:  ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS.  SHOULD ANY SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE COMPETITIONS/CONTESTS.

  15. DISPUTE REGARDING THE IDENTITY OF AN ENTRANT: Eligible Finalists, winners’ and individuals will be the person, School representative or the school itself who registered and who submitted a Submission Form/Registration Form, placed a vote and/or entered the Contest. If a dispute arises regarding who submitted an on-line Submission Form/Registration Form, placed a vote, or entered the Contest, the Submission Form or vote or entry will be deemed to have been submitted by the authorized account holder of the e-mail address provided at the time of Submission; voting or entering provided the name of the authorized account holder corresponds with the full name on the Registration Form. The authorized account holder is defined as the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider, or other organization responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  If the name of the authorized account holder does not accord with the full name on the Submission Form/Registration Form, the entry may be disqualified at the independent contest organization, Judges and/or Sponsor's sole and absolute discretion.

  16. FOR QUEBEC RESIDENTS: Any litigation respecting the conduct and awarding of a Prize may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a Prize may be submitted to the Régie des alcools, des courses et des jeux only for the purpose of helping the parties reach a settlement.

  17. GENERAL: This Competition is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux for Quebec, to terminate, modify, or suspend this Competition or to amend the Official Rules at any time and in any way, without prior notice, for any reason whatsoever. Without limiting the foregoing, if for any reason the Competition is not capable of running as originally planned, for example as a result of tampering or infection by computer virus, Sponsor reserves the right, with the consent of the Régie des alcools, des courses et des jeux for Quebec, to terminate the Competition and conduct a random draw or selection process from all previously received eligible entries.

  18. RULES GOVERN. In the event of any discrepancy or inconsistency between the Official Rules or Submission Form and disclosures or other statements contained in any Promotional related materials, including, but not limited to, the Registrant’s Information, the Official Rules shall prevail, govern and control.

  19. INTELLECTUAL PROPERTY: All intellectual property, including but not limited to trade-marks, trade names, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations are owned by either Sponsor and/or their respective affiliates or authorized licensors. All rights are reserved. Unauthorized copying or use of any copyrighted materials or intellectual property without the express written consent of its owner is strictly prohibited.

  20. CONSENT TO USE PERSONAL INFORMATION: Sponsor respects your right to privacy. By entering this Competition electronically and voluntarily providing your personal information in the Registration Form, you consent and agree to Sponsor’s collection and use of that information to administer this Competition including the Sponsor sharing with your personal information with its third party service providers for the purposes of administering and conducting this Competition, including verification of eligibility and identity and awarding and delivering prizes. 

    If you consented on the Registration Form, Sponsor may also use your contact information you provided upon entry to contact you to promote draws, interactive features and other upcoming contests, promote opportunities to subscribe to Sponsor newsletters and promotional clubs, notify you about programs and special events. Your information will be handled according to the privacy policy at http://www.majesta.com/Privacy-Policy/. Your consent to Sponsor’s use of the information you provided on entry may be revoked at any time (without revoking your participation in the Contest or impairing your chances of winning) by sending an e-mail with the words “unsubscribe” in the subject line to comments@majesta.com.
